Important Notice to Customers: Stand-Up Paddle Boarding & Kayaking

1. General Warnings:
Stand-up paddle boarding (SUP) and kayaking are physically demanding water activities that carry inherent risks. These activities should only be attempted if you are in good physical condition and possess adequate swimming skills. Always wear a properly fitted U.S. Coast Guard-approved personal flotation device (PFD), use a leash (for SUP), and be aware of weather, tide, and water conditions. Alcohol, drugs, or reckless behavior significantly increase the risk of injury or death. Equipment must be inspected before each use. We do not guarantee your safety and assume no responsibility for injuries resulting from improper use or failure to follow safety instructions.

2. Assumption of Risk:
By renting, purchasing, or participating in SUP or kayaking activities through our business, you voluntarily assume all risks associated with these activities. These risks include, but are not limited to, drowning, collision with objects or vessels, exposure to sun and weather, equipment failure, and personal injury or death. You are solely responsible for assessing your abilities and making informed decisions on the water. You understand and accept full responsibility for any harm or loss you may suffer.

3. Arbitration Agreement:
In the event of a dispute or claim related to your use of our equipment, participation in our activities, or this agreement, both you and our company agree to resolve the matter exclusively through final and binding arbitration. Arbitration will be conducted under the rules of the American Arbitration Association (AAA), and judgment on the arbitrator’s award may be entered in any court with proper jurisdiction. By agreeing to arbitration, you waive your right to sue in court or participate in a class-action lawsuit.

4. Binding Effect of Agreement:
This agreement is legally binding upon you, your heirs, executors, administrators, and assigns. By using our equipment or participating in SUP or kayaking activities facilitated by our business, you confirm that you have read, understood, and agreed to all terms. If any provision is found unenforceable, the remaining terms shall remain in full force and effect.

By participating in stand-up paddle boarding or kayaking, you acknowledge that you have read and understood this notice and agree to be bound by its terms.
